ORDINANCE NO. 7-237 – 2011

AN ORDINANCE OF THE CITY OF ELGIN, NEBRASKA, TO AMEND SECTION 7-237 OF THE OFFICIAL MUNICIPAL CODE TO PROVIDE FOR A PERMIT FEE; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THESE ORDINANCES IN ACCORDANCE WITH STATE LAW.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF ELGIN, NEBRASKA:

SECTION 1: That Section 7-237 of the Official Municipal Code is hereby amended to read as follows:

SECTION 7-237: WELLS AND OTHER FACILITIES; PERMIT REQUIRED; FEE

A. From and after the effective date of this ordinance, it shall be unlawful for any person, corporation, or other legal entity to drill and/or operate any of the following facilities within the corporate limits of the City without first having obtained the proper permit from the City Council: potable water well; any otherwell; sewage lagoon; absorption or disposal field for water cesspool; dumping grounds; feedlot; livestock pasture or corral; chemical product storage facility; petroleum product storage facility; pit toilet; sanitary landfill; septic tank; sewage treatment plant; sewage wet well.

B. In order to obtain a permit to drill and/or operate any of the facilities listed herein, the owner of property on which the proposed facility is to be located must make application on the proper form provided by the City Council. Such application must be presented to the Council at any regular or special meeting. After reviewing the application of any person desiring to drill or operate any of the above-described facilities, the City Council must approve or deny said permit.

C. The fee for the permit to drill and/or operate any of the facilities listed herein shall be $1000.00, with said fee to accompany the application. The permit fee shall be refundable if the permit is not approved by the City Council.

These Ordinances shall be in full force and effect from and after their passage, approval and publication as provided by state law.
