ORDINANCE NO. 627
AN ORDINANCE OF THE CITY OF ELGIN , NEBRASKA, ACCEPTING AND APPROVING THE FINAL PLAT OF MEADOWBROOK SUBDIVISION; DIRECTING THE SAME TO BE RECORDED BY THE ANTELOPE COUNTY REGISTER OF DEEDS; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN ACCORDANCE WITH STATE LAW.
WHEREAS, Capital Select, LLC, by and through Janet Koinzan, Member, as the owner of real estate legally described herein has sought approval of the final plat of certain real estate within the City of Elgin and has caused the same to be surveyed, platted and designated as “Meadowbrook Subdivision” and has agreed that t he streets and public ways shown thereon shall be freely and voluntarily dedicated to the public for its use forever; and
WHEREAS, the City of Elgin held a public hearing regarding the approval of said final plat; and
WHEREAS, the City Council of the City of Elgin, Nebraska, has approved the final plat of the “Meadowbrook Subdivision “ legally described as follows:
Lot 1, Block 1, all of Block 2 and all of Block 3, located in Cooper’s Addition amended plat City of Elgin, Antelope County, Nebraska, including 100 foot wide Fremont, Elkhorn and Missouri Valley Railroad Company abandoned right of way lying coincident with the east line of said Blocks 1, 2, and 3 more particularly described as follows: Beginning at the SW corner of said Block 3; Thence N00•32’19 “W, and on the west line of said Blocks 3 and 2, 527.94 feet to A 5/8 “ rebar w/cap, said rebar being the SW corner of Lot 3, Block 1; THENCE N89•38’18”E, and on the south line of said Lot 3, Block 1, 140.54 feet to a 5/8 “ reba r w/cap , said rebar being the SE corner of Said Lot 3, Block 1; THENCE N00•36’29”W, and on the east line of Lots 2 and 3, Block 1, 265.37 feet to the NE corner of said Lot 2, Block 1; THENCE N89•40’ 55”E, and on the North line of Lot 1, Block 1, 279.73 feet to a 5/8 rebar w/cap On the easterly R.O.W. Iine of said abandoned railroad; THENCE S07•13’ 52 “ E, and on the easterly R.O.W. line of said abandoned railroad 797.95 feet THENCE S89•32’29”W, and on the south line of said Block 3, extended east 512.94 feet to the point of beginning and containing 7.63 acres more or less.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF ELGIN, Section 1 :The above-described real estate shall be known as Meadowbrook Subdivision of the City of Elgin, Antelope County, Nebraska;
Section 2: The attached and incorporated final plat of Meadowbrook Subdivision is approved by the City Council of the City of Elgin, Antelope County, Nebraska;
Section 3: The Antelope County Register of Deeds is directed to record the final plat of the Meadowbrook Subdivision referenced herein;
Section 4: Capital Select, LLC is directed to provide the City of Elgin with a verified recorded copy of the final plat immediately upon its recordation with the Register of Deeds.
Section 5: The City Council of the City of Elgin, Antelope County, Nebraska, hereby accepts the dedication of the streets and public ways noted thereon; and
Section 6: This Ordinance shall be in full force and effect on and after its passage of approval as provided by State Law;
Approved and passed by the governing body of the City of Elgin, Nebraska this 7th day of January, 2013.
