ORDINANCE NO. 3-308
AN ORDINANCE OF THE CITY OF ELGIN, NEBRASKA, PROVIDING FOR THE REGULATION OF KENNELS; PROVIDING FOR KENNEL LICENSES AND REGULATIONS; PROVIDING FOR THE FILING OF THIS ORDINANCE IN THE OFFICE OF THE CLERK OF THE COURT OF ANTELOPE COUNTY, NEBRASKA; AND PROVIDING FOR PUBLICATION AND THE EFFECTIVE DATE OF THIS ORDINANCE.
Be it ordained and enacted by the Mayor and City Council of the City of Elgin, State of Nebraska, as follows:
§3-308 KENNEL; TERMS DEFINED. The term “kennel” shall be construed to include any establishment for the raising, training, boarding or selling of dogs, cats, birds, mice, rats or other small animals for hire or profit or where more than three dogs or three cats are harbored or kept.
§3-308.01 KENNEL; LICENSE. It shall be unlawful to operate a kennel anywhere in the City without first securing a license therefore. Said party seeking said license shall make written application to the City Council and the Council in the event it shall allow said kennel to exist within the corporate limits of the City shall set forth whatever regulations for said kennel which they deem appropriate. Said license shall be on an annual basis and may be revoked for violation of the standards and regulations set forth by the City Council after due notice and hearing to said kennel owner or operator. The annual fee for such kennel license shall be five hundred ($500.00) dollars.
§3-308.02 KENNEL; REGULATIONS. Every place used as a kennel shall be kept in a clean and sanitary condition and no refuse or waste material shall be allowed to remain thereon for more than 24 hours. All animals shall be humanely treated and any animal having any disease shall be properly isolated and treated. All kennel operators shall be bound by all the rules and regulations set forth in this Chapter.
