Notice of Public Hearing — UENRD

NOTICE OF PUBLIC HEARING
REGARDING CHANGES TO CHEMIGATION REGULATIONS OF UPPER ELKHORN NATURAL RESOURCE DISTRICT
Pursuant to Nebraska Revised Statutes, § 46-701 et seq., the Upper Elkhorn Natural Resources District (“UENRD”) hereby provides notice that a public hearing shall be held on Monday, February 23, 2015 at 3:00 p.m. in the Upper Elkhorn NRD meeting room, 301 N. Harrison Street, O’Neill, NE . As required by law, the purpose of the hearing is to receive testimony and other evidence concerning the proposed chemigation regulations. The geographic area proposed for the chemigation regulations encompasses all of the land area located within the boundaries of the UENRD. A general description of the proposed regulations are as follows: (1) General definitions are established; (2) Any person wishing to use chemigation must obtain a permit from the UENRD; (3) Any person wishing to use chemigation must be certified as required by the Nebraska Department of Environmental Quality to do so; (4) Provides procedures for the chemigation permitting process; (5) Provides procedures for renewal of chemigation permits; (6) Provides for special permits; (7) Provides for emergency chemigation approval; (8) Provides for permit suspension and/or revocation of chemigation permits if there is a threat to the public or environment from chemigation, or if the permit was violated in any way, including false or fraudulent information in obtaining the permit; (9) Provides for application fees to reflect the cost of administration and inspections of the UENRD chemigation program; (10) Provides for inspection of all chemigation systems by UENRD representatives; (11) Specifies the type of equipment that must be used with any chemigation system; (12) Requires public posting on chemigated fields; (13) Requires reporting of any actual or suspected accidents related to chemigation systems.
Any interested person may appear at the hearing and present written or oral testimony concerning the proposed regulations. Individuals with disabilities may request auxiliary aids and service necessary for participation by contacting UENRD by February 17, 2015. Testimony or other evidence relevant to the purposes of the hearing may also be submitted in writing to UENRD at 301 North Harrison Street, O’Neill, Nebraska 68763, by 4:00 p.m., February 23, 2015.
