Road Closing Hearing

BE IT RESOLVED, by the Board of Supervisors of Antelope County, Nebraska, that a public hearing date be set for 10:30 AM the 12th day of July, 2011 to consider whether or not to vacate or abandon the east-west county roadway located between Section 14 and 23, Township 27 North, Range 6 West of the 6th P.M., Antelope County, Nebraska.

Adopted this 7th day of June, 2011, at Neligh, Nebraska.

Elgin City Council Proceedings

Emergency Meeting Proceedings

The Elgin City Council met for an emergency meeting on Tuesday, June 14, 2011 at the Elgin City Hall. Notice of said meeting had been posted at three places, namely, U.S. Post Office, Dean’s Market, and the Elgin City Hall, as prescribed by law.

Mayor Schmitt called the meeting to order at 11:00 a.m. and announced the location of the Open Meeting Act.

Council members present were Jim Kittelson, Don Mackel, and Shirley Nissen. Councilman Kenny Jochum was absent.

Also present was Don E. Poulsen, Vicki S. Miller, Jennifer Tharnish, John Zwingman, Bob Moser, Denny Duer, and Brian Fitzgerald.

Purpose of said meeting was to discuss plans for a fire storage building with the City Engineer and architect Denny Duer, so an estimated cost could be obtained.

Following the discussion, measurements and inspection of the site were taken.

A complete and accurate copy of the minutes are available for public inspection at the City Clerk’s office during normal business hours.

Meeting ended at 11:45 a.m.

Notice to Irrigators

You are herewith informed that Section 39-703 of the Nebraska Statutes, 1975 session laws, provides that it is unlawful to divert water onto or across a public road so as to saturate, wash or impair the maintenance, construction, or pass ability of such public road and that upon conviction thereof such person shall be punished by a fine for every such offense of not less that $10.00 nor more than $100.00.  Provided, this section shall not apply under the following conditions:

(1)  When the damage has been caused by a mechanical malfunction of the irrigation equipment,

(2)  When a sprinkler irrigation system had been set so that under normal weather conditions no water would have been placed upon the right of way of any road, or

(3)  When the County Board grants permission to the land owner to divert water along a county road right of way or when a municipality has granted such permission.

You are further notified that the County Board of Supervisor’s intends that the above stated law shall be enforced and that any persons having a complaint for violation of the above stated irrigation law may make a proper complaint to either the County Sheriff or the County Attorney.

Weed Notice — Antelope County

Section 39-1811 of the Nebraska Revised Statutes for 1943, reissue of 1974, requires that all land owners mow all weeds that can be mowed with the ordinary farm mower to the middle of all public roads and drainage ditches running along their lands, at least twice a year, namely, before July 15th, for the first time and during the month of August of second time, since many of the roads are not mowed at this time the County Board requests that the roadsides be mowed immediately.  The law further provides that in the event the land owner fails to mow said weeds, the County Board, upon complaint of any resident, may cause the weeds to be mowed and assess the cost for the mowing of such weeds against the land abutting each side of the road where the weeds were mowed by the County and that such cost may be collected in the same manner as real estate taxes.

The County Board of Supervisor’s of Antelope County, Nebraska has received several complaints regarding weed in road ditches.  The County Board urges all land owners to mow the weeds in the road ditches and on the sides of the roads abutting their respective properties immediately.

The county board would also like to remind land owners, that they are responsible for keeping the roadside adjacent to their property free of voluntary trees.
